I. Seminar on the theory of labor law, 10.11.2022, at 9:00 am: 

paper entitled: "About the axiological justification of norms and problems with its definition"

was delivered by  Prof. Marek Piechowiak

The meeting will be devoted to the analysis of selected definitions of axiological justification. Reflection on their weaknesses is to lead to proposing definitions more adequate from the point of view of constitutional decisions indicating the recognition of axiological cognitivism by the constitution-maker.

II. Seminar on the theory of labor law, 22.11. 2022 r., at 9:00 am:

paper entitled: "Universally applicable law and internal law against the background of company sources of labor law"

was delivered by Prof. Arkadiusz Sobczyk

During the seminar, the systemic perspective of company sources of labor law will be considered. That is why it will serve as a background for considerations about the mutual relationship between universally applicable law and internal law. The poorness of the current scientific reflection in this area is also intended to encourage discussion of lost opportunities for not only the potential understanding of labor law as a fundamental element of the Polish socio-economic system, but also for seeing the whole issue of the sources of law in the constitutional perspective, which has been narrow so far.

W trakcie seminarium chcemy przyjrzeć się ewolucji prawa pracy w kontekście jego umiejscowienia w systemie prawa i wynikającym z tego konsekwencjom. Jak się okazuje, temat jest aktualny nie tylko w polskim obrocie społeczno-gospodarczym i prawnym, ale także francuskim. We francuskim otoczeniu prawnym proces publicyzacji prawa pracy, a dokładnie poddanie tego prawa silnej ingerencji prawa administracyjnego, notuje się na lata 70-te poprzedniego stulecia. Lata 80-te to zasadnicze zelżenie tego wpływu i jego powrót na początku lat 2000-nych, przy czym  w oparciu o inną logikę, niż ta, która towarzyszyła temu wpływowi w latach 70-tych. Na ile doświadczenia francuskie i ich ocena przez doktrynę, mogą okazać się przydatne w analizie ewolucji przynależności systemowej norm polskiego prawa pracy będzie zasadniczym punktem rozważań tego seminarium.

En 1981, le syndicat Solidarité avait revendiqué avec force l'espoir d'un mieux social. Plus de trente années après la fin du communisme, ces illusions sociales se sont évanouies face au réalisme économique. Une politique néo-libérale brutale motivée par le soi-disant besoin d'un rattrapage avec les pays occidentaux a laissé derrière elle un véritable champ de ruines sociales. Les réformes successives du droit du travail reflètent à elles-seules cette lente dégradation et à quel point notre État-social a pu être démantelé. referat pt.: “Fundamentos de derecho del trabajo español: rasgos configuradores y ámbito de aplicación”

Catedrático de Derecho del Trabajo y de la Seguridad Social de la Universidad de Alcalá (Madrid, España). Investigador principal de la línea de investigación de Relaciones Laborales y Protección Social del Instituto Universitario de Investigación en Estudios Latinoamericanos (IELAT) de la Universidad de Alcalá

La ponencia desarrolla los principales aspectos que configuran el Derecho del Trabajo español desde el punto de vista de sus presupuestos normativos. Se presta especial atención al grado de cumplimiento del Derecho del Trabajo español de las reglas internacionales de la OIT y de la Unión Europea. Desde el punto de vista del Derecho interno español, se analiza la configuración del Derecho del Trabajo en la Constitución democrática de 1978, una vez superada la dictadura previa (1939-1975). Siguiendo un modelo democrático y plural de relaciones laborales, se analiza la principal norma general española relativa a la ordenación del trabajo por cuenta ajena, el Estatuto de los Trabajadores. Asimismo, se tratan dos aspectos fundamentales, desde el punto de vista del trabajo protegido y con derechos, que se refieren a la salud laboral y a la protección social del trabajo.

Aspectos a desarrollar:

1. El Derecho del Trabajo español ante el estándar internacional de la OIT.

2. La adaptación del Derecho del Trabajo español al Derecho Social Europeo.

3. La constitucionalización de la protección del trabajo en la Constitución Española de 1978. 

4. Sistema de fuentes. La importancia del Estatuto de los Trabajadores (ley general laboral). 

5. Seguridad y salud en el trabajo.

6. Seguridad Social y trabajo protegido.   

Series of seminars: 

“On the foundations of labour law in todays’s Poland”

As part of six meetings, we want to look at the foundations of Polish labor law from the constitutional perspective, reading its basic legal institutions in accordance with the axiological pillars of the Constitution of the Republic of Poland and, as a result, building a common starting point for the discussion on labor law in Poland.Therefore, I would like to thank the professors who agreed to participate and deliver individual lectures from this constitutional perspective, which is so important for labor law.
